Jerry Garcia's guitars top 500K at auction [the moral of the story?]

A couple of years ago Bonhams and Butterfields' auction of Grateful Dead memorabilia from the Ram Rod Shurtliff Collection fetched more than $1.1-million -- garnered from competitive bidding on telephones and in the crowded San Francisco auction room. Top lots of the day included guitars played on stages and in-studio by Jerry Garcia, original art used on album covers and equipment and collectibles associated with the Grammy Award-winning band.

Lawrence ‘Ram Rod’ Shurtliff, long-time Road Manager and President of the Grateful Dead’s corporation, passed away in 2006. The property on offer was consigned for sale by his son Rudson Shurtliff.

The moral of the story?

Keep everything to do with your band and your music … those scraps of paper with lyrics on? The old amplifiers that don’t work? The guitars? The posters .. the flyers. The demos, the promotional copies of singles. Itineraries, tour contracts. Check out the amount of stuff on EBay re. my band, The Bachelors…. Even the concert contracts are currently up for grabs. Wish I knew where they were sourced. Yep, there is my signature.

Who makes the chart? [ how does all the info get collected ]

Airplay … how important is it to chart position?

In the USA, that alone is pretty mind boggling. But Nielson [OCC in the UK] doesn't rest on its laurels with that level of data collection. They have another resource for program managers called Nielson Soundscan that collects sales information from over fourteen thousand music retail outlets including record stores, Wal-marts and even online retail sources such as Amazon. This system is highly sophisticated, so much so that new data from Soundscan is available to radio program directors every Wednesday from the previous week's sales.

These systems have been in place for some time and we all know that how music is being promoted and sold is changing rapidly. One of those big changes is that a large portion of the music consumer world has moved toward P2P [person to person] file sharing and downloading resources to learn about new music. Well, radio has no time to worry about the morality of such systems. They need to know what is getting popular so they can respond quickly.

If a new band breaks on the internet, that buzz can move so quickly that it would be easy for radio to miss out and be out of the loop entirely. And this has been somewhat of a problem especially when file sharing became a big part of the music world a few years ago.

So now, traffic of music over the major P2P systems such as Limewire and Kazaa is being tracked to be included with the statistics radio stations use to determine airplay. The name of the program that is doing the tracking is BigChampagne which is owned by Clear Channel Communications. Clear Channel clearly have a vested interest in knowing what is breaking on the internet in that they own hundreds of radio stations all over the country.

So … the proper charts?

In the UK, the Official Charts Company (OCC) is a joint venture between record labels' body the The British Recorded Music Industry (BPI) and the Entertainment Retailers Association (ERA). The OCC is responsible for the commissioning, marketing, distribution and management of the UK's industry standard music and video charts and is endorsed by the British Video Association (BVA).

The OCC compiles its charts from sales information gathered across all key distribution (or entertainment) channels including all major high street retail chains, independent stores, supermarkets, mail order internet retailers and digital music service providers. This market research sample equates to 99% of the total UK Singles market; 98% of the total UK Albums market and 90% of the total UK DVD market.

“Hi Dec,

My name is D***. I am from the United States. My Love is Music. I have been told I have top hit songs.

I belong to the Song Writers Publishers Guild and I am a Lifetime member. I had started about 12 years ago in my venture to get Published one of my Songs and have a copy write with Country Wine Publications and a contract that never went anywhere. They offered to buy my song for 3,500.00 dollars, and I turned it down. They wanted to do it in house by another singer. I just didn't feel right about it....

I then contacted Bruce Goodwin out of Nashville, as I am a country writer and singer. He is a producer. He could do nothing about that song as it was a binding contract with Country Wine Publications.

But he asked me for 10 or 15 songs to put together a CD. I sent a few to Him to Proof and waited for the next step to the sum of 10,000,00 to get the Recording contract.

It ended up being too much money on my end....I figured if He was really interested in me and had so much faith....He would of produced me and my songs for free and taken the chance on success...Right?

Anyhow, My songs are 2nd to None. They speak truth and are written from my deepest part of my Soul. People say I'm in the wrong profession as a Mechanic, Have been for the last 25 years.

Can someone of my age miss there calling? Everyone says No! I know there is a lot of money to be made in the music industry....But that is not my goal. I Love to sing and write. The Lyrics reach people and that is what counts. I do not want to bore you with all of this as I'm sure many have. So I will ask you in all Honesty and good faith what do you offer?

Thanks
D***”

Wheeeeeeh!

You have some baggage … some pre-conceived ideas?

I can help you … but a lot of what you say tells me a sad story. And nothing I say here is meant to insult, denigrate, put you down or annoy you … I am known for being straightforward and forthright [they reckon Simon Cowell took his inspiration from me!]

Let’s take your worries in order….

<<<<<<<<<. I have been told I have top hit songs.>>>>>>>>>>>>

Yep, every friend will tell you that you have top songs … but it is the music buying public who have the last say? At the shop counter and buying downloads?

<<<<<< my venture to get Published>>>>>>>>>

Any publisher will publish any song [fact!] … it is making money that counts - not having a song published.

<<<<< a contract that never went any where.>>>>>>>>>>

As I say “any publisher will publish any song” … a publishing contract is only a piece of paper … that does not mean that they will make money for you. They wait until you get fed up, then you do the job properly [as we advise] then, when the track is at Number Three they show up and collect all the publishing royalties. That is why we always advise having your own publishing company http://makehits.co.uk/publishing.htm .. an imperative.

<<<<<<<< They offered to buy my song for 3,500.00 dollars,>>>>>>>>

You should have snapped their hand off! Mind you, I doubt if they would have parted with the money. The time to negotiate is when you are Number Three in the chart … not before.

<<<<<<<< he asked me for 10 or 15 songs to put together a CD>>>>>>>>>>>

No genuine producer of Hit Songs will ever ask for money to produce … only small expenses to cover out of pocket stuff [taxis, hotels etc] … this sorts out the proper producers from the cowboys. What is better? $3,000 now or 5% of $Millions for life?

<<<<<< My songs are 2nd to None>>>>>>>>

Then show me your bank balance? [a vicious but true and honest question]

<<<<<< They speak truth and are written from my deepest part of my Soul>>>>>>>

Nobody … but nobody, gives a monkey’s where a hit song comes from … trust me! They just want a memorable, easy to sing, toon, to bop to and to sing along to on a Saturday Night Girls Night Out…. That is the short and tall of it! Oh, they also want luscious ballads to snog and do other sensuous activities to. Covers the noise of the body parts? Anyone who says different is an amateur. And they abound at the open mic. nights. And in most Music Groups and forums on the Net.

<<<<<<<<< Can someone of my age miss there calling?>>>>>>>

Absolutely! The most important factor in life is that you have to “learn how to learn” … the art and technique of hit song writing and hit song producing is not stumbled upon while strolling on the beach …. A fact of life! You have to learn it and learn it hard. Just about as hard as learning to be a brain surgeon.

But don’t ever listen to the “music making is just for the young” … “you have to be in this game at 16” … “you lose your skills with age” … that thinking is codswallop. You are only old if you want to be old.

<<<<<<< I know there is a lot of money to be made in the music industry....But that is not my goal.>>>>>>>>>

And that is the nub of the problem you have. You have hit it right on the head … and you HAVE to change.

Successful music is all about making dosh … since Beethoven, Stravinsky, Chopin, Richard Rodgers, Sting, U2, Beyonce, Kanye West.

That statement of yours is the worst statement the Record companies want to hear … they want to make money for their shareholders, directors, employees, rent, electric, heating … and you tell them you don’t want to make money from your music???? Why would they want a partner with an attitude like that?

<<<<<< The Lyrics reach people and that is what counts>>>>>>>

Then try writing for your local church … forget about our business! [a hard but true fact]

<<<<<<<< what do you offer?>>>>

Exactly what is on the package.

"Whatever you give a woman, she will make greater..

If you give her sperm, she'll give you a baby.
If you give her a house, she'll give you a home.
If you give her groceries, she'll give you a meal.
If you give her a smile, she'll give you her heart.
